Vaping Laws
Since 1 July 2024, new laws are in place to outlaw the commercial supply and advertisement of single-use, non-therapeutic e-cigarettes (vapes) in Australia.
In Victoria:
- all e-cigarettes, whether they contain nicotine or not, can only be sold in a pharmacy to help people to quit smoking or manage nicotine dependence
- an e-cigarette, regardless of whether it contains nicotine, cannot be legally supplied or sold to a person under 18 years old
- it is illegal to sell, barter or exchange any type of tobacco or e-cigarette product to a person under 18 years of age
- it is illegal to smoke or vape in a motor vehicle if a person under 18 years is also present in the motor vehicle.
- a person must not smoke any type of e-cigarettes within school premises and within 4 metres of any pedestrian access to school premises.
The Department of Education has developed resources to help you learn more about the health risks of smoking and vaping. The resources include advice about how to talk to children and young people about vaping, and where to get support.
