NSW to tighten rules on price guides

Recent media reports highlight significant reforms being advanced by the NSW Government to address underquoting. These changes should serve as an important reminder for all NSW sales agents and principals about the rising compliance expectations around price representation.

 

The proposed reforms substantially increase penalties, with fines of up to $110,000 or three times the commission now under consideration. This reflects government concern that current penalties are not strong enough to deter poor practice. The publicity generated by these stories also signals a heightened appetite for enforcement and public accountability.

 

The reforms go further than penalties. Every listing will need a clear price guide, supported by documented evidence showing how that estimate was reached. This is likely to include comparable sales, market trends, and suburb-level analysis. Stronger obligations around record-keeping will also apply, with officers able to request proof of how an estimate was formed and why it may have changed during a campaign.

 

For agents, the message is straightforward. Any gap between the published estimate and your documented justification creates risk. The updated laws aim to eliminate ambiguity and ensure buyers are not misled about a property’s likely price.

 

Now is an ideal time to review your pricing methods, advertising templates, and internal processes. Do your price guides stand up to scrutiny? Is your evidence file complete? Are changes in buyer feedback being recorded? Taking these steps will help you avoid compliance issues and strengthen your professional standing at a time when the sector is under close examination.

Victoria orders early reserve disclosures to curb under-quoting

The Victoria Government has announced reforms aimed at cracking down on under-quoting in the property market. Under the new laws, agents will be required to publish the vendor’s actual reserve price at least seven days before any auction or fixed-date sale

 

Failure to disclose the reserve within that timeframe will mean the property cannot legally proceed to auction or be offered for sale.The reforms also require all marketing material to be updated to reflect the published reserve, with any outdated advertising to be removed immediately.
