Understanding the no smoking clause in tenancy agreements

 

Glen Ford, from FN Progressive (Christchurch), is sharing important knowledge on social media regarding tenancy agreements and smoking rules. Section 43AA of the Residential Tenancies Act allows tenancy agreements to prohibit smoking tobacco products indoors on the property. Smoking may also be banned in other areas of the premises if it aligns with the rights and obligations of both landlord and tenant. “Indoors” excludes outbuildings, and the term “premises” includes facilities.
