VCAT Rules on Access Charges - update 

Important development on VCAT "access charges" decision

You may recall a recent update we provided in early April 2020 informing you of a potentially important VCAT decision which will dramatically impact the way in which agencies impose access charges for electronically stored material.  

That VCAT decision is now the subject of a Supreme Court Appeal commenced by the respondent agency.  

In those circumstances, we strongly suggest that until the Supreme Court rules on the correctness or otherwise of the VCAT decision, previous practices should be followed in determining access charges for electronically stored information.
